1. Scope and Application
These Data Usage Terms & Conditions ("Data Terms") govern your use of satellite imagery, GIS data, and related geospatial products provided by Geosurveys & Geospatial Information Limited ("GGIL").
Applicable Data Products:
- KOMPSAT satellite imagery (all resolutions and processing levels)
- Custom GIS datasets and derived products
- Geospatial analysis results and reports
- Sample imagery and demonstration materials
- Technical specifications and metadata
Legal Framework:
- These Data Terms supplement our main Terms of Service
- Must be accepted for each GIS data request or order
- Subject to Kenya law and international export control regulations
- Incorporate third-party licensing requirements from data providers
2. Data Licensing and Usage Rights
2.1 License Grant
Standard License: Upon payment and acceptance of these terms, GGIL grants you a non- exclusive, non-transferable license to use the licensed data products solely for the purposes specified in your order.
Licensed Uses:
- Internal business analysis and decision-making
- Academic research and educational purposes (with restrictions)
- Commercial project development and implementation
- Professional consulting and client services
- Government and public sector applications
2.2 Geographic and Temporal Scope
Coverage Limitations:
- License applies only to specific geographic areas ordered
- Temporal coverage limited to imagery acquisition dates specified
- Archive imagery subject to availability and historical coverage
- New acquisition imagery subject to satellite scheduling and weather
Usage Boundaries:
- Use restricted to licensed geographic area and specified buffer zones
- Derivative products must relate to originally licensed area
- Expansion of geographic scope requires additional licensing
- Temporal analysis permitted within licensed dataset boundaries
2.3 User Categories and Permissions
Commercial Use:
- Business analysis, site selection, and feasibility studies
- Infrastructure planning and development projects
- Agricultural monitoring and precision farming applications
- Environmental consulting and impact assessment
- Market research and competitive analysis
Academic and Research Use:
- Non-commercial research and academic study
- Educational course materials and student projects
- Scholarly publication with proper attribution
- Conference presentations and academic conferences
- Thesis and dissertation research projects
Government Use:
- Public sector planning and policy development
- Emergency response and disaster management
- Urban planning and zoning analysis
- Environmental monitoring and protection

3. Prohibited Uses and Export Control
3.1 Strictly Prohibited Activities
Redistribution and Resale:
- Selling, leasing, or sublicensing data to third parties
- Distributing raw imagery files or processed datasets to third parties
- Incorporating data into commercial products for resale
- Sharing data with unauthorized users or organizations
- Creating derivative datasets for commercial distribution
Technical Violations:
- Reverse engineering satellite sensor characteristics
- Removing or altering metadata, watermarks or attribution information
- Circumventing technical protection measures
- Using data to develop or improve competing satellite imagery products
- Extracting underlying algorithms or processing techniques
Legal and Ethical Violations:
- Activities violating data protection, export control or trade compliance laws
- Use for illegal surveillance or privacy violations
- Supporting sanctioned entities or prohibited destinations
- Military or defense applications without appropriate licenses
- Activities conflicting with human rights principles
3.2 Export Control Compliance
Regulatory Framework:
KOMPSAT satellite imagery is subject to multiple export control regulations. All users must comply with the following regulatory frameworks:
Applicable Export Control Regimes:
- 1. Republic of Korea Export Controls
- o KOMPSAT satellites are Korean government assets operated by Korea Aerospace Research Institute (KARI)
- o Subject to Ministry of Trade, Industry and Energy (MOTIE) export control regulations
- o Primary regulatory authority for satellite operations and data distribution
- 2. International Traffic in Arms Regulations (ITAR)
- o KOMPSAT satellites contain U.S.-origin components subject to ITAR
- o ITAR compliance is mandatory for all imagery distribution and use
- o Applies to all users and distributors regardless of location
- 3. Kenya Trade and Data Protection Laws
- o Kenya Data Protection Act 2019 compliance requirements
- o Trade and export regulations under Kenyan jurisdiction
- o Local licensing and regulatory obligations
- 4. International Sanctions Regimes
- o United Nations Security Council sanctions
- o African Union sanctions and restrictions
- o Other multilateral treaty obligations
3.2.1 End-User License Agreement (EULA) Requirement
Mandatory EULA Signature:
All clients must sign an End-User License Agreement (EULA) before receiving any KOMPSAT satellite imagery products. This is a standard requirement for KOMPSAT imagery distribution.
EULA Requirements:
- Covers export control compliance obligations
- Specifies permitted uses and redistribution restrictions
- Includes copyright attribution requirements
- Contains legal liability and indemnification clauses
EULA Process:
Before receiving KOMPSAT imagery, you must sign an End-User License Agreement. GGIL will provide and explain the EULA, with particular focus on export control requirements, to ensure you understand your obligations.
Copyright Attribution Required:
All KOMPSAT imagery use must include: "© Korea Aerospace Research Institute (KARI). Distributed by SI Imaging Services (SIIS) through GGIL."
3.2.2 Restricted Destinations
Comprehensively Embargoed Countries:
The following countries are subject to comprehensive embargoes where virtually all transactions are prohibited:
- Cuba
- Iran
- North Korea
- Syria
- Crimea, Donetsk, and Luhansk regions of Ukraine
Countries with Targeted Sanctions:
Specific restrictions on certain activities, sectors, and entities:
- Russia (significantly expanded restrictions since 2022 Ukraine invasion)
- Belarus
- Venezuela
- Myanmar (Burma)
Additional Restricted Destinations:
Countries subject to various international restrictions and requiring enhanced due diligence:
- Afghanistan
- Central African Republic
- Democratic Republic of the Congo
- Lebanon
- Libya
- Somalia
- Sudan
- South Sudan
- Yemen
- Zimbabwe
Specially Designated Nationals (SDN):
- All orders screened against U.S. OFAC Specially Designated Nationals List
- Over 17,000 individuals and entities worldwide
- Restrictions apply regardless of physical location
- Includes persons and organizations connected with sanctions targets
3.2.3 Restricted End Uses
Prohibited Applications:
- Military or defense-related activities without appropriate government licenses
- Intelligence gathering or surveillance operations without legal authorization
- Activities supporting sanctioned entities or prohibited destinations
- Use in violation of international humanitarian law or human rights principles
- Border security operations in conflict zones without proper authorization
High-Risk Applications Requiring Pre-Approval:
- Defense and national security operations
- Critical infrastructure monitoring in sensitive regions
- Government intelligence or law enforcement applications
- Border surveillance and military reconnaissance
- Nuclear facility monitoring
Level 1A (L1A) Export Control:
Raw, unprocessed Level 1A imagery requires additional export approvals from SIIS/KARI and may be restricted for certain destinations, applications, or end-users.
3.2.4 User Certifications
By accepting these Data Terms, you certify that:
- You are not located in, incorporated in, or a national of restricted destinations
- You are not listed on any SDN or restricted party list
- Your organization is not owned or controlled by sanctioned entities
- Your intended use complies with Korean export regulations, ITAR, Kenya laws, and international sanctions
- You will not export, re-export, or transfer data to prohibited parties or destinations
- You will not use data for restricted military, intelligence, or surveillance purposes without licenses
- You will obtain all necessary government approvals for your intended use
- You will maintain accurate records of data usage for 5 years’ minimum
- You will sign and comply with the EULA provided by GGIL
3.2.5 Compliance Obligations
Ongoing Requirements:
- Screening: Verify all data recipients against restricted party lists
- Record-Keeping: Maintain accurate records of data transfers and usage for minimum 5 years
- Notification: Inform GGIL immediately of any circumstances affecting export compliance
- Cooperation: Assist with compliance audits or government inquiries
- Reporting: Report suspected violations or diversion attempts to GGIL
- Training: Ensure staff handling data understand export control obligations
License Requirements:
If your application requires government export licenses:
- Obtain necessary approvals before receiving data
- Provide copies of licenses to GGIL for records
- Comply with all license conditions and restrictions
- Notify GGIL of any license modifications or revocations
3.2.6 Consequences of Violations
User Consequences:
- Immediate termination of license and all data access rights
- Obligation to destroy or return all licensed data immediately
- Loss of future service eligibility with GGIL and partner providers
- Referral to appropriate government enforcement authorities
Legal Consequences:
- Korean Penalties: Prosecution under Korean export control laws and regulations
- U.S. Penalties: ITAR violations carry civil fines up to $1 million per violation and criminal penalties including imprisonment
- Kenya Penalties: Prosecution under Kenya trade and data protection laws
- International Sanctions: Enforcement actions by UN and other international bodies
Your Indemnification:
You agree to defend, indemnify, and hold harmless GGIL, SIIS, and KARI from all claims, damages, and costs arising from your export control violations.
3.2.7 Compliance Support

- Guidance on licensing requirements
- Compliance documentation assistance
- Regular regulatory updates

3.2.8 Geographic and Application Restrictions

- Areas subject to territorial disputes
Partner Restrictions:
SIIS/KARI may impose additional restrictions on:
- Specific countries or regions
- Particular end-users or organizations
- Certain applications or use cases
- High-resolution or specialized products
4. Attribution and Intellectual Property
4.1 Attribution Requirements
Mandatory Attribution:
All use of licensed data must include proper attribution as specified below:
For KOMPSAT Imagery:
"Satellite imagery © [Year] Korea Aerospace Research Institute (KARI). Distributed by SI Imaging Services (SIIS) through Geosurveys & Geospatial Information Limited (GGIL)"
For Processed Data Products:
"Data analysis by Geosurveys & Geospatial Information Limited (GGIL) using KOMPSAT satellite imagery © [Year] KARI, distributed by SIIS"
For Academic Publications:
Include full citation: "KOMPSAT satellite imagery provided by Geosurveys & Geospatial Information Limited, Nairobi, Kenya, under license from SI Imaging Services and Korea Aerospace Research Institute"
4.2 Intellectual Property Rights
Third-Party Rights:
- KARI retains all rights to KOMPSAT satellite imagery and related products
- SIIS retains distribution and licensing rights
- Satellite sensor technology and processing algorithms remain proprietary to KARI
- Orbital mechanics and acquisition planning systems protected
- Metadata and technical specifications subject to original provider rights
GGIL Value-Added Rights:
- Custom processing methodologies and analytical techniques
- Derived products and analytical results created by GGIL
- Quality assessments, accuracy evaluations, and fitness determinations
- Integration services and technical consultation deliverables
Client Rights:
- Results and analysis specific to your project objectives
- Custom reports and presentations prepared for your use
- Business intelligence and strategic recommendations provided
- Integration of your data with licensed satellite imagery
5. Data Quality and Accuracy
5.1 Technical Specifications
KOMPSAT Satellite Standards:
- Panchromatic resolution: 0.4-1.0 meters depending on satellite
- Multispectral resolution: 1.6-4.0 meters depending on satellite and processing
- Radiometric resolution: 10-14 bits per pixel
- Geometric accuracy: Better than 10 meters without ground control points
Processing Levels Available:
- Level 1R: Radiometrically corrected imagery
- Level 1G: Geometrically corrected imagery
- Level 1O: Ortho-ready imagery (for selected areas)
- Custom processing: Tailored to specific project requirements
5.2 Quality Disclaimers
Inherent Limitations:
- Satellite imagery subject to weather conditions and atmospheric effects
- Cloud coverage or seasonal variations may obscure ground features in some imagery
- Temporal currency limited to satellite acquisition dates
- Resolution and accuracy specifications are nominal and may vary
Fitness for Purpose:
- Data provided for general geospatial analysis purposes
- Specific fitness for intended application not guaranteed
- Users responsible for evaluating suitability for specific projects
- Professional judgment required for critical applications
No Warranty:
- Data provided "as is" without warranty of merchantability or fitness for a particular purpose
- No guarantee of specific accuracy or quality levels
- Weather and technical factors may affect imagery characteristics
- Users assume responsibility for validation and quality assessment
6. Security and Data Protection
6.1 Data Handling Requirements
Security Obligations:
- Protect data using appropriate technical and organizational measures
- Restrict access to authorized personnel only
- Implement secure storage and transmission protocols
- Maintain confidentiality of sensitive project information and ensure staff handling personal data are bound by confidentiality undertakings
Access Control:
- Limit data access to employees requiring it for authorized purposes
- Implement user authentication and authorization controls
- Monitor data usage and maintain access logs
- Report suspected security breaches immediately
6.2 Data Storage and Retention
Storage Requirements:
- Store data securely using encryption and access controls
- Backup data according to business continuity requirements
- Protect against unauthorized access, modification, or destruction
- Maintain data integrity throughout storage and processing lifecycle
Retention Limits:
- Retain licensed data only for duration of authorized use
- Delete or return data upon license expiration or termination
- Maintain records of data destruction for compliance purposes
- Exception for academic research subject to extended retention agreements
7. Support and Maintenance
7.1 Technical Support

- Support requests acknowledged within 24 hours
- Technical assistance provided during business hours

7.2 Data Updates and Corrections
Error Correction:
- Report data quality issues or technical problems promptly
- GGIL will investigate and provide corrections or replacements
- No additional charges for correcting data delivery errors
- Alternative data sources provided if primary data unavailable

- New acquisition imagery available subject to satellite scheduling
- Archive imagery updates provided as historical data becomes available
- Technical improvements and processing updates applied to new orders
- Notification of significant changes to data specifications or availability
8. Pricing and Payment
8.1 Pricing Structure
Standard Pricing:
- Archive imagery: KSh 1,000-5,000 per km² depending on resolution and processing
- New tasking: Custom pricing based on area, urgency, and specifications
- Rush delivery: Premium charges for expedited processing and delivery
- Volume discounts available for large area coverage or multiple orders
Additional Services:
- Custom processing and analysis: Hourly or project-based rates
- Format conversion and technical customization: Standard service fees
- Extended support and training: Professional services rates
- Special acquisition parameters: Additional satellite tasking charges
8.2 Payment Terms
Payment Schedule:
- Advance payment required for new clients and large orders
- Established clients eligible for 30-day payment terms
- Payment due upon data delivery for standard orders
- Custom projects subject to milestone-based payment schedules
Currency and Methods:
- Pricing in Kenya Shillings (KSh) with USD alternatives available
- Bank transfer preferred for large transactions
- Credit card payment available for smaller orders
- International wire transfer accepted with additional fees
9. Liability and Indemnification
9.1 Limitation of Liability
Maximum Liability:
- Total liability limited to amount paid for specific affected data products
- No liability for consequential, indirect, or speculative damages
- No responsibility for business interruption or lost profits
- Force majeure events exclude liability for performance delays
Specific Exclusions:
- Weather-related imagery quality limitations
- Satellite technical failures or scheduling changes
- Third-party service interruptions affecting data delivery
- Export control restrictions preventing data delivery
9.2 User Indemnification
Indemnification Obligations:
Users agree to indemnify and hold GGIL, SIIS, and KARI harmless from:
- Export control violations resulting from user's improper data use
- Third-party claims arising from user's data applications
- Intellectual property violations in user's derivative works
- Compliance failures related to user's data handling practices
- Costs and damages from failure to obtain required EULA signatures
- Any claims arising from user's breach of these Data Terms
10. Termination and Data Return
10.1 License Termination
Automatic Termination:
- License expires upon completion of authorized use period
- Immediate termination for material breach of usage terms
- Termination for non-payment or violation of export regulations
- Emergency termination for security breaches or misuse
Termination Effects:
- Immediate cessation of all data use rights
- Obligation to delete or return all licensed data
- Survival of confidentiality and intellectual property obligations
- Payment obligations for services received remain in effect
10.2 Data Return and Destruction
Return Requirements:
- Return all original data files and derivative products
- Delete all copies from systems, backups, and archives
- Provide written certification of data destruction
- Exception for academic research subject to retention agreements
Verification Process:
- GGIL may request evidence of data deletion or return
- IT audit rights reserved for significant compliance concerns
- Cooperation required with data verification procedures
- Legal action available for non-compliance with return obligations
11. Dispute Resolution and Governing Law
11.1 Dispute Resolution Process
Initial Resolution:
- Direct communication with GGIL data services team
- Technical disputes resolved through expert technical review
- Commercial disputes addressed through account management
- Documentation required for all dispute claims and resolutions
Formal Procedures:
- Mediation through qualified mediation services in Kenya
- Arbitration under Kenya Arbitration Act for unresolved disputes
- Expert determination for technical and quality disputes
- Court jurisdiction in Kenya for enforcement and appeals
11.2 Governing Law and Compliance
Legal Framework:
- Agreement governed by laws of Kenya
- Export control compliance subject to Korean, U.S., and international regulations
- Intellectual property rights protected under applicable international treaties
- Data protection requirements according to Kenya Data Protection Act

Acceptance Requirements:
- Continued data use constitutes acceptance of updated terms
- New orders subject to current version of data usage terms
- Existing licenses remain subject to terms in effect at time of grant
- Material changes require explicit acceptance for ongoing use
